This Terms of Service agreement (“Agreement”) is a legally binding contract between you (“User,” “you,” or “your”) and MED PREPS LLC (“Company,” “we,” “us,” or “our”), the operator of the NRCME Prep website located at nrcmeprep.com (the “Site”) and all related services (collectively, the “Service”).

By accessing or using the Site, creating an account, or purchasing access to any content, you acknowledge that you have read, understood, and agree to be bound by this Agreement and our Privacy Policy. If you do not agree to these terms, you must not use the Service.

1. Description of Service

NRCME Prep provides online practice questions, quizzes, practice examinations, and related study materials designed to help licensed healthcare professionals prepare for the National Registry of Certified Medical Examiners (NRCME) certification exam administered by the Federal Motor Carrier Safety Administration (FMCSA). The Service is intended for educational and exam preparation purposes only.

The Service is not a substitute for the FMCSA-approved training course required before taking the NRCME exam. The Service does not confer any medical credential, certification, or license. MED PREPS LLC is not affiliated with, endorsed by, or sponsored by the FMCSA, the U.S. Department of Transportation, or any government agency.

2. Eligibility

The Service is intended for use by adults who are licensed healthcare professionals or students in healthcare programs. You must be at least 18 years of age to create an account or purchase access. By using the Service, you represent and warrant that you meet these eligibility requirements.

3. Account Registration and Security

To access paid content, you must create an account and provide true, accurate, current, and complete information as prompted by the registration form (“Registration Data”). You agree to maintain and promptly update your Registration Data to keep it accurate and current.

You are solely responsible for maintaining the confidentiality of your account credentials, including your username and password. You are fully responsible for all activities that occur under your account. You agree to immediately notify MED PREPS LLC of any unauthorized use of your account or any other breach of security. MED PREPS LLC will not be liable for any loss or damage arising from your failure to protect your account credentials.

If you provide information that is untrue, inaccurate, or incomplete, or if MED PREPS LLC has reasonable grounds to suspect as much, we reserve the right to suspend or terminate your account and refuse any current or future use of the Service.

4. Account Sharing Prohibited

Each purchase grants a personal, non-transferable license to a single individual. Your account may not be shared with, transferred to, or used by any person other than the registered account holder. Concurrent use of a single account from multiple devices or locations may be used as evidence of unauthorized sharing.

MED PREPS LLC reserves the right to monitor account usage patterns and to immediately terminate, without refund, any account where unauthorized sharing is detected or reasonably suspected. In the event your account is terminated for violation of this section, you agree not to re-register under a different username or identity.

5. Payment and Access

Access to the full NRCME Prep question bank requires a one-time payment at the price displayed at the time of purchase. This is a single payment, not a recurring subscription. Upon successful payment, you receive unlimited access to all practice questions, quizzes, and examinations available at the time of purchase, as well as any content updates made thereafter.

All payments are processed securely through Stripe, a PCI-DSS Level 1 certified payment processor. MED PREPS LLC does not store, process, or have access to your full credit card number, CVV, or other sensitive payment credentials. By submitting payment, you authorize the charge to your selected payment method.

Prices are subject to change without notice. Any price change will not affect purchases already completed. All prices are displayed in U.S. dollars unless otherwise stated.

6. Refund Policy

Refunds are available within seven (7) calendar days of purchase subject to certain conditions. Please review our complete Refund Policy for eligibility requirements, exclusions, and instructions for submitting a refund request. All sales are final after the seven-day refund window has closed.

7. Acceptable Use

You agree to use the Service only for its intended purpose of personal exam preparation. You agree not to:

Reproduce, duplicate, copy, download, distribute, publish, or share any content from the Service, including but not limited to questions, answer choices, explanations, or any other proprietary materials, whether in whole or in part, by any means including electronic, print, screenshot, or oral communication
Use automated tools, bots, scrapers, spiders, crawlers, or any other automated means to access, extract, index, or collect content from the Service
Attempt to gain unauthorized access to the Service, other user accounts, or any computer systems or networks connected to the Service
Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, or data structures of the Service or its software
Resell, sublicense, lease, lend, or commercially exploit any portion of the Service or its content
Use the Service for any unlawful purpose or in violation of any applicable local, state, national, or international law or regulation
Introduce viruses, trojans, worms, or any other malicious code or software that may damage or interfere with the operation of the Service
Interfere with, disrupt, or place an undue burden on the Service, its servers, or the networks connected to the Service
Impersonate any person or entity or falsely represent your affiliation with any person or entity

8. Intellectual Property and Proprietary Rights

All content on the Service, including but not limited to questions, answer choices, explanations, text, graphics, logos, images, software, and the compilation thereof, is the exclusive property of MED PREPS LLC and is protected by United States and international copyright, trademark, and other intellectual property laws.

You are granted a personal, non-transferable, non-exclusive, revocable license to access and use the Service solely for your own individual exam preparation. This license does not include the right to copy, modify, distribute, sell, or create derivative works from any content on the Service.

MED PREPS LLC reserves the right to terminate your license and account without refund if it is determined that you have violated this section. Unauthorized reproduction or distribution of the Service’s content may result in civil and criminal penalties under applicable law, and MED PREPS LLC will pursue all available legal remedies.

“NRCME Prep,” “MED PREPS,” the NRCME Prep logo, and all related names, marks, and designs are trademarks or service marks of MED PREPS LLC. You may not use any of these marks without prior written permission.

9. No Resale of Service

You agree not to reproduce, duplicate, copy, sell, resell, or exploit for any commercial purpose any portion of the Service, use of the Service, or access to the Service. Any unauthorized commercial use of the Service or its content shall constitute a material breach of this Agreement.

10. Disclaimer of Warranties

YOU EXPRESSLY UNDERSTAND AND AGREE THAT:

(a) YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. MED PREPS LLC EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

(b) MED PREPS LLC MAKES NO WARRANTY THAT (i) THE SERVICE WILL MEET YOUR REQUIREMENTS, (ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE RESULTS OBTAINED FROM USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE, (iv) THE QUALITY OF ANY CONTENT OBTAINED THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS, OR (v) ANY ERRORS IN THE SERVICE WILL BE CORRECTED.

(c) WHILE OUR CONTENT IS VERIFIED AGAINST THE CURRENT FMCSA MEDICAL EXAMINER’S HANDBOOK, MED PREPS LLC DOES NOT GUARANTEE THAT USING THE SERVICE WILL RESULT IN PASSING THE NRCME EXAM OR ANY OTHER EXAMINATION. EXAM OUTCOMES DEPEND ON MANY FACTORS INCLUDING YOUR INDIVIDUAL PREPARATION, KNOWLEDGE, AND TEST-TAKING ABILITY. NO PASS GUARANTEE IS OFFERED OR IMPLIED.

(d) ANY MATERIAL OBTAINED THROUGH THE USE OF THE SERVICE IS ACCESSED AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE USE OF SUCH MATERIAL.

(e) NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM MED PREPS LLC OR THROUGH THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THIS AGREEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MED PREPS LLC, ITS OFFICERS, DIRECTORS, MEMBERS, MANAGERS, EMPLOYEES, AGENTS, CONTRACTORS, AFFILIATES, OR LICENSORS (COLLECTIVELY, THE “INDEMNIFIED PARTIES”) BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

YOUR USE OF OR INABILITY TO USE THE SERVICE
THE COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES
UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR ACCOUNT OR DATA
STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE
FAILURE TO PASS ANY EXAMINATION AFTER USING THE SERVICE
ANY OTHER MATTER RELATING TO THE SERVICE

IN NO EVENT SHALL THE TOTAL LIABILITY OF THE INDEMNIFIED PARTIES TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU ACTUALLY PAID TO MED PREPS LLC FOR ACCESS TO THE SERVICE.

12. Indemnification

You agree to indemnify, defend, and hold harmless MED PREPS LLC and the Indemnified Parties from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Service, (b) your violation of this Agreement, (c) your violation of any rights of another party, or (d) any content you submit, post, or transmit through the Service.

13. Modifications to Service

MED PREPS LLC reserves the right at any time to modify, update, suspend, or discontinue the Service, or any part thereof, with or without notice. This includes the right to add, remove, or modify questions, quizzes, features, or functionality. You agree that MED PREPS LLC shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service. In the event of permanent discontinuance, liability is limited to the purchase price you paid, prorated to the amount of time since your purchase.

14. Modifications to Terms

MED PREPS LLC may revise this Agreement at any time by updating this page. We will indicate the date of the most recent revision at the top of this page. We encourage you to review this Agreement periodically. Your continued use of the Service after any modifications constitutes your acceptance of the revised Agreement. If you do not agree to the updated terms, you should discontinue use of the Service and contact us.

15. Termination

MED PREPS LLC may, in its sole discretion, terminate or suspend your account and access to the Service at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to: violation of this Agreement, account sharing, content redistribution, fraudulent activity, or conduct that MED PREPS LLC believes is harmful to other users or the business.

Upon termination, your right to use the Service will immediately cease. MED PREPS LLC may deactivate or delete your account and all related data. In the event of termination for cause, no refund will be issued. The provisions of this Agreement that by their nature should survive termination shall survive, including but not limited to Sections 8, 10, 11, 12, and 17.

16. Links to Third-Party Websites

The Service may contain links to third-party websites or resources. These links are provided for convenience only. MED PREPS LLC has no control over such sites, does not endorse them, and is not responsible for their content, privacy practices, or availability. You acknowledge that MED PREPS LLC shall not be liable for any damage or loss caused by your use of or reliance on any third-party content, goods, or services.

17. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict of law provisions. Any dispute, claim, or controversy arising out of or relating to this Agreement or your use of the Service shall be resolved exclusively in the state or federal courts located in the State of Missouri. You consent to the personal jurisdiction of such courts.

If you are located outside of the United States, you agree that by entering into this Agreement, you voluntarily submit to the jurisdiction of the courts of the State of Missouri. You agree that MED PREPS LLC may satisfy its obligation to provide you with legal notice by sending communication to the email address associated with your account.

You agree that any claim or cause of action arising out of or related to the Service or this Agreement must be filed within one (1) year after such claim or cause of action arose, or it shall be permanently barred.

18. Severability

If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the intent of the parties.

19. Entire Agreement; No Waiver

This Agreement, together with the Privacy Policy and Refund Policy, constitutes the entire agreement between you and MED PREPS LLC regarding your use of the Service, and supersedes all prior agreements, communications, and understandings.

The failure of MED PREPS LLC to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.
